It is NOT different and that is the OP's point. He has a pic from iOS and one from the Touchpad to show how they are pixel for pixel indistinguishable.

Cool, thanks for the pics. They are different...and quite a bit the same. Looks like Apple took an icon, and added some flair to it. And it IS a different shade of blue! I was right! I was right...I ...was...oh, sorry.

And I agree it is a bunch of nonsense to be at a place where discussions like this occur. But IMHO it does seem that Apple is ravenous about attacking others who might take a little apply item and 'improve' on it, but when they do it, they seem to get by with out such legal attacks. This discussion is just a reflection back at Apple...a 'physician heal thyself' moment for them you might say. No big thing...but it is annoying, again IMHO.

So... Apple had that look for Messaging in 2007 when Rubinstein moved to Palm, Palm implemented it and Apple sat on the look of the icon for 5 years to dust it off and bring it to iOS?

Sounds like a Lawyer-ish argument.
