I seriously doubt there is anything Sprint could do about it even if they wanted to. It's not clear to me that they could actually detect the fact that My Tether is running the way things are currently. It's not like the old phone as modem where you actually dial in to the Sprint network from your computer. My Tether is actually sharing the internet connection--your phone is always the primary connector to the network. As long as people don't do the "Sprint is now my primary ISP" thing, I think we're pretty safe.
Sprint is already getting good money out of us. If they were really smart, they would charge us an extra $5-10 per month for the capability and make a little more, and then everything would be above board. But since they're not doing that, and just saying we can't, people are going to make the mods necessary to do it. Can't provide a device with these kinds of capabilities and expect people aren't going to use them.
