    As I said before, my refurbished phone stinks. It got that funky smell.

    I would just get me another 800w new on ebay and sell this refubished one. But I am waiting for the Pro.

    Neither.

    On "...the free upgrade should be easier". I still cannot find any policy from Sprint on this. When you call them, they are not aware of a Treo Pro--in other words, I'm very skeptical that Sprint is going to allow, en masse, free upgrades from the 800w to a Treo Pro.

    Are you guaranteeing to members at TC that this is a confirmed policy from Sprint and that we all should be able to do this? Do you stand by that assertion?

    As of yesterday, when anyone calls telesales, there is no mention of a Treo Pro and the staff was not aware of it.

    Yes, I stand by that assertion. In fact, I also assert that no one has anything marked on their account for a "free upgrade" to the Treo Pro as well.

    The Treo Pro was on the Sprint website when I was browsing it at around 1am EST. Your assertion is wrong, they do know about it because it came off the website a few hours later. I am sure there was a stink internally about it. Probably not good press but they do know about it.

    How does a web developer (or even the whole e-commerce team) knowing about it mean that all the reps out there know about it?

    How does any of that effect the fact that reps are told by giving out information prior to the day it goes on sale, they can get terminated?

    When I worked for Sprint, if anyone asked me a release date of a phone, even if I knew (which I usually knew more about it from TC than from internally), I wouldn't tell you. I don't know you from Adam, and certainly not worth risking my job over.

    I mean, as Ebag notes, no CS reps were aware of it...you know, the people who modify your account, do exchanges, give you credits, order you a phone, etc. No, I did not talk to Hesse but I assume he "knows" about a the Treo Pro, lol.

    That is what I am talking about--its called context, lol. The conversation with nsxprime was in relation to talking to Sprint and ordering the phone--he knows that. Up till yesterday, if you called Sprint and asked about a Treo Pro, swapping it out for one, etc. they disavowed any knowledge of it.

    So I find it implausible that "many people" are "getting a free upgrade" from their 800w, since there was nothing in the system to do enable such a transaction. Same reason even if you store has one, they can't sell it.

    (And Gearlog has a statement from Sprint. In short, the device is not certified for use on Sprint's network yet. All orders are now on hold/back ordered.)

    I think you are both right, except for this part. CS reps could absolutely see the sku yesterday in store.

    It is perfectly understandable for them to not acknowledged it at all it is embargoed info and could hurt 800w sales, hurt sales by other channels, (bestbuy, radioshack, sprint affiliate stores)

    Yup. They've got warehouses full of the duds that they still need to clear out.

    My upgrade is directly from a local store who got bombarded by busted 800w's with a multitude of bugs. Mal already knew that though.

    Vibrant, you make is seem as if someone at Sprint knows about the Treo Pro. Odd.

    It could be very helpful to users here at TC if they want to upgrade, especially if like the OP, they are having problems with their 800w--so I'm just trying to get to the bottom of it.

    There isn't a public policy and there isn't going to be a public one. If you go through the BBB Palm will give you cash for the invoice price. For the typical 800w invoice price is before rebate and resign perks (line credits) but after instant ie $350.

    File with the BBB and someone will call you and offer you exactly those terms no questions asked. They know they have to.

    In my opinion, With Sprint it is more complicated. IMO If you bought on September 5 and and questioned it you would have been referred to the palm faq, know there was no fix and had your 30 day option. I think it is still complicated in the sense that maybe you first tried standalone on October 7, etc.

    But clearly people who bought in July and whose 30 day had elapsed and had inquired before the faq have the strongest ethical and legal grounds to make demands on sprint and or palm.

    Multiple users have made BBB claim and trhe result is the same, a offer to buy back at invoice.

    Results from sprint are clearly more variable. A certain number of people may have been making inquiries for a long time, had conflicting and incorrect answers on record (perhaps even in writing). Perhaps their standing with sprint (which is actually a metric created by sprint) has an effect. Perhaps they supplied sprint with sprint engineers statements and definitions of exactly what autonomous GPS is.

    If this were pushed as a class the settlement would likly be quantified as the cost of a puck or perhaps an upgrade.

    I think a lot of us got soured by the fact that early on the problem was denied, when it was confirmed in early august there was an implication a fix was being worked on, and the fix turned out to be that faq.

    I am not sure people here -- especially since the faq was fully discussed and could be intelligently seen as the last word on a fix -- who bought the device within 30 days of, or after, the faq should be howling too loudly. Those who bought it 30 days before the faq in my opinion have a very very strong case should they decide to press it.

    To the OP and the on topic post: I f you are freezing a lot with no added programs you likely have a defective device and you should get a replacment 800w

    Sort of like saying used cars are OK. In some cases they are, but new often is best.
