But you might get a refurb as they dont have to give you a brand new phone since you didn't purchase the phone from them.
I know this wasn't directed towards me,I think Aero understands what he is saying, I just think Reyrey is making a mountain out of a mole hill. What difference does it make whether you drive the car to a sprint store to swap your phone or to Best Buy? If you buy the phone at best buy and wanna swap it in the first 30 days, just drive the car to Best Buy instead of the sprint store! There problem solved!

Let's stop the misinformation. Any Sprint employee will verify this.

Fact: If you buy it at best buy, and have any issues whatsoever Sprint and its stores will give you the identical support as if you bought it from them.

They will service or exchange it on the spot no questions asked if you buy form any authorized seller (and apparently, in practice, unauthorized ones as well).
    That is written sprint policy.

And if they dont, you should politely get their name and the name and number of their regional manager and let the RM straighten the person you are having problems with out.

Actually I am also talking about the tax on the retail price, based on the MARKED up retail price on Best Buy. Someone posted earlier a link that describes what I am talking about when you buy at BB in CA.
    That is all.

I find it humorous that you did NOT expect this.

Here's a link to a document by the CA Board of Equalization (the CA Tax Collector - and as an aside, doesn't it sound kinda socialist? Let's tax everyone to the point that everyone is equal!) regarding the taxation of cell phone sales in California:

    http://www.boe.ca.gov/pdf/pub120.pdf

Basically, it says that if you buy a cell phone at a price that requires a contract (bundled price), then you have to pay sales tax on the NON-CONTRACT price (unbundled price).

    Yes, it sucks.

Palm and Sprint should offer the phone for $199 without having to submit a mail in rebate. It took 5 months for me to get mine, which Sprint totally screwed up by giving me half of the amount due to me. It took several emails, phone calls, and an additional 3 weeks to get the rest.

This is the reason I plan on going to BestBuy, I have a BestBuy and reward zone card so extra bonus.

No what he said was they wouldn't support it. So I didn't misunderstand a thing.

But the way people swap out phones bought from ebay at Sprint stores.

Right and as we have said all along it varies by state. Equal or less. In my state tax is on marked down price.

When I bought my last Treo, the Sprint store filled out the rebate and mailed it for me, if anybody cares. It's not as good as instant, but it is very low hassle. They also charged the phone to my account which meant the bill was a month away. That bill was then automatically charged to my credit card, which meant it was a second month away followed by a third month of grace period with no finance charges. The result is I got cash before I paid for the phone, didn't pay any finance charges, and I didn't fill out any forms, didn't mail anything, and didn't pay for any stamps. It is true that one down side is if your area has sales tax you pay the tax on the $100.

Aero i NEVER said SUPPORT was an ISSUE and I NEVER said anything about EBAY... i never said that. If you have sprint service you can go to any sprint store and get help, BUT if you want to exchange the phone on the spot, since you have a BB phone they will tell you to go back to BB within the 30 days. Sprint store will not exchange on the spot. This could be state to state like I said, but CALIFORNIA is this way so how is my information false... NOW APOLOGIZE!!. Here is the quote of what I said:

Wow... what I am saying is that it is easier to return to Sprint ONLY if you want to replace it with a newer batch phone (this may not apply to pre launch) within 30 days. If you bought it from BB you cannot return it to Sprint and get a newer batch phone, you would need to go through the following steps I mentioned earlier. YOU CAN RETURN, but NOT EXCHANGE. That is my point.

Do you know which other states have this policy?

So if what the OP said is true; Lets say I buy a defective Pre from Best Buy and need to exchange it but they run out due to limited supply. What happens if they don't get more phones in within the 30 days?

If BB runs out, you still need to go back to BB within. Sprint will not exchange it for you. BB will not run out and if they do, they will likely call around to see which stores have more to get you another new one. If you go to Sprint, they can only if you have TEP or pay money, they will 1. try to fix it, 2. send it to Asurion and you may get a refurb or a new one. BUT since the Pre is new and they don't have any refurb, you may likely get a new one.

Sprint warrants that Best Buy phone for the first month, and for the first year.

You will have zero problme going to Sprint to exchange or fix it at Sprint whether you bought it at Best Buy, Radio Shack Walmart or Sprint.

You do not even need TEP for that.

    That is Sprints written policy.
