    There has been a lot of activity lately and this way it should be a bit more clear...

    And if it turns out to be a hoax we can merge the threads back...

    so far I have not seen any solid proof the EOS is reall... but it could be so the jury is still out..

    one thing bothers me though.. the name... I'm sure VW has trademarked it for their hardtop converable:

    And it also belongs to Canon, right? That was the first thing I thought of when I saw "Eos".
    HP has officially ruined it's own platform and kicked webOS loyalists and early TouchPad adopters to the curb. You think after you drop it like a hot potato and mention it made no money and is costing you money, anyone else wants it??? Way to go HP!!

    And some people are fools to keep believing their hype. HP has shown they will throw webOS under the bus and people are still having faith in them??? News flash: if it's own company won't stand behind it, it's finished!

    The leak of the info on this device doesn't phase me one bit, actually it's great news for me. This looks like the one I'll be shooting for. It's GSM, It's about the size of my current T|C and it's running Web OS. Win, Win, Win!

    and "iphone" belongs to cisco.

    eos is a lot less confusing to the customer than the above.

    I believe in trademark law a disputed name has to be in a similar category for an infringement case to proceed. So most people would not confuse a car with a smart phone and I would assume legally a trademark name of a camera would not infringe on a smart phone but that would be a gray area since mobile phones have camera functions and are increasingly becoming strong competitors in this market.

    deesugar is correct. I work in trademark law. Trademarks are divided into classes of goods and services, and unless two products are in the same class, AND it is determined that there could be confusing similarity for potential customers, there is no trademark infringement. There are many existing popular trademarks that are used in multiple classes, such as Viper: the car, the car alarms (probably the same class, but not likely to be confused), the cameras, or Crest: the toothpaste, the audio systems, the boats. SO Palm would have no problem getting a trademark for EOS, at least not because of Volkswagen or Canon. Canon might try to argue it because the phone has a camera, but they would likely lose, and I doubt they'd fight it too hard.
