    Palm Sued Over Defective Treos

    A new lawsuit is being brought against Palm over defective Treo 600 and Treo 650 smartphones. The suit claims the Treo fail at unacceptably high rates, are inherently defective and that Palm has mislead customers concerning the defects.


    The suit Palza v. Palm was filed in the Superior Court of California, in Santa Clara County. It was filed on behalf of three Treo customers, but seeks to be certified as a Class action lawsuit, so that all Treo users would be represented.

    The suit mainly claims that Palm has made misrepresentations and concealed information in the marketing, advertising, sale and servicing of its Treo 600 and Treo 650 models. It further states that Palm has been aware for a substantial period of time that the Treos were failing at a very high rate and Palm has not warned its customers or tried to prevent them from suffering system failures and data loss.

    Some of the complaints include:

    Extremely poor sound quality and buzzing which is heard by the recipients of telephone calls, which makes the Treo unusable and makes recipients believe that the Treo owner is in a very noisy place when making the phone call (not caused by telephone service provider).
    Voice choppiness which is heard by the recipients of telephone calls which makes the Treo an extremely poor telephone (not caused by telephone service provider).
    Speakerphone problems making the speakerphone unusable or seriously impaired.
    Phone freezes and crashes often causing restarts and lost calls, which often require the use of a hard reset which loses all stored information (not caused by telephone service provider).
    Replacement of defective Treo 600 phones with defective and/or “refurbished” Treo 600 phones - creating a cycle of defective product - whereby owners continue to receive defective products until either they tire of the process or their warranty runs out.

    My treo 600 has been rock solid. I won't give it up for a 650 unless a new model does not come out by spring.

    BTW-It sounds like a double negative on one of choices " I won't never be a Palm customer" Won't/never sounds like will not/never which would be 'will'. ;-)

    Frankly, I'd prefer the lawsuit to fail. I'd like Palm to stay in business and continue making Treos.

    I don't necessarily want something from Palm as a handout, rather I want this lawsuit to send a strong message to them. Think about it. For the average user (i.e. someone who doesn't live on this message board) the Treo is too buggy. There are things such as poor voice quality, frequent resets, etc, that are very frustrating for a regular user. I understand many of the resets are a result of 3rd party s/w, but the core Palm OS isn't rock-solid, even after all this time. I've heard too many people say their free Nokia/Motorola phone has MUCH better voice clarity than their Treo. That's unacceptable.

    If Palm could produce a Treo that is rock-solid stable, and one that *gasp* actually has crystal clear phone calls, then they will make so much more $ and have a better image among it's customer base. If this lawsuit prompts Palm to make these two minor corrections, then it served it's purpose as fas as I'm concerned.

    FWIW, my Treo is pretty stable, but the OS could still use some tweaking. It took a great deal of careful s/w selection and user tweaking to get it this stable. For the average user, it is still too buggy.

    I'm going to buy whatever new Treo comes out next (NOT a Windows one, however), so I really don't care what they do. I consider myself a power user, and can deal with a few resets, but I am most certainly in the minority of Treo users.

    Just make it work like a Nokia, and everyone will be happy.

    I hope it gets dismissed too, but I also hope Palm steps up their customer service as a result of this event.

    I am with this lawsuit. I find it insulting that Palm leaves it to customers to hack at their device in order to get any sort of real functionality. Not only that, but functionality that they had already promised but never delivered. I for one am sick of all of Palm's empty promises. I expect, either a new device that works to my satisfaction or I will drop Palm and never buy another device again. And I'm not the only one, I know of companies that have been planning on dropping the phone altogether and going Blackberry. In 1996 Palm made a product. A PDA that had functionality we could all use, in a nice little package. A product that never crashed, never lost data, had great battery life. Since then their products have deviated from this. And I'm afraid that if they don't get back on track soon, they're gonna lose a LOT of business. Personally, I would start selling all your Palm shares while you still can, because unless they pull a rabbit out of their ### your stocks will be worthless within the first few days at the end of this lawsuit. Just my 2 cents, take it for what it's worth.

    Oh yeah, and don't say they've progressed. I watched my 300's lid shatter, they did nothing. I watched my 600 (they promised bluetooth and WiFi right on the box) idle by uselessly. Now I'm not watching my 650 because it crashes every time I look at it! Something needs to be done, I know I've tried contacting Palm's useless Customer Service who points me to Cingular's CS who then sends me back to Palm. This lawsuit will end the recursive process and finally open Palm's eyes. Guess what Palm, your products suck. Just because you control a large portion of the PDA market doesn't mean that A) You're the only one out there or B) I like your product. Hmmm...can you say "reality check"?

    I consider my self a power user like you!! I LOVE MY TREO. Unfortunately I did not vote I'm OK because I suffer the freezing problem .

    I can absolutely live with few resets (actually I have not more than 1 reset every two days ).
    I can live with the voice quality that in my opinion is not that bad.
    I can't live with the freezing problem expecially because I lost important calls and messages .
    I can't live with the customer service policy Palm has, at least in Italy .

    I am also a power user and I love my Treo, but I've resorted to TreoCentral too often to get fixes for simple things. This suit appears frivolous but someone has to hold Palm accountable.

    I don't think Palm has ever shown that they care about the customer. Why do so many people want to stand up for them?

    A Treo without third-party apps is IMO not much better than most other phones. The Palm OS apps (but not the OS) are what makes it shine. Yet we've read reports about Palm providing no assistance to the developer community.

    For example, with all that BS they spewed out at the roadshow about how the 650 had the longest beta testing period ever, how could Versamail have been such a loaded piece of garbage?

    How could the initial 'out of memory' crashes not have been dealt with before release?

    They made a big deal about ActiveSync and I gave up on getting it to work days after I got my 650.

    Why did I have to reset my calendar DB because HotSync wasn't working?

    Perhaps some financial repurcussions will finally get them to fix their act. Even if they lose, I don't see them going out of business. But it would be nice to see them finally held accountable.

    The Treo is the best device on the market right now, but I predict that LG or one of the WM manufacturers will produce something better soon (I predicted that last year and the 6700 would have been it if it was just a little thinner). I have a lot invested in Treo accessories and the Palm OS and would love to see it stay on top. Maybe this is the wake up call they needed. Maybe they'll continue on their lackadaisical ways.

    I've had a few T600's replaced, the most recent has been rock solid. All T600's have been highly tweaked and have been fine otherwise.

    One of my son's has a T650 which had a screen defect upon delivery. It was cheerfully replaced by Rogers. He has not done anything to customize or tweak his T650 and it is also rock solid.

    We love our Treos!

    i do not want to see palm go out of business! i would like to see better customer service though. As already stated above, i hate being transferred to a 3rd world country to speak with someone that doesnt understand english and have them say "did you try a soft reset?". It is beyond frustrating when you spend $400-$500 or a product and i rely almost soley now on this forum for support know palm will never email, call, or write me back. It only seems fair to support what you sell. other than that i like the phone and can manage.

    I think it's entirely reasonable to give current Treo owners a discount just for being royal customers.

    For me, it's definately nice to have service-oriented wireless service providers between me and Palm.

    As both a business and personal customer of VZW, I had confidence when buying my Treo that VZW would make sure I was satisfied with the hardware or easily replace it as they have done in the past. Between this and $5.99/month total insurance coverage ($50 deductible), I felt really good about making the transition from a Palm pda to Treo smartphone.

    PS - I love my Treo too!
