    I'm no lawyer, just play one in discussion boards, but...

    I would have to agree with those who say $1000 is fair. I don't mean fair to your perspective, but legally fair. It would seem a stretch that a judge would award you anymore money once the insurance has been settled. I guess you could file small claims and see where it takes you.

    And to those gagging on a 3K laptop, ever price a 17" Powerbook??

    Woof, why the anger? I was merely "preparing" you for what COULD occur in court, since -- it appears -- the two of you did not have a written/verbal contract. Besides, as with the others here, I am brainstorming ideas and suggestions for your benefits. You asked for suggestions from TC members and I gave them to you.
    Try contacting this person again and make him an offer to pay you back, in monthly payments, the remaining $2000. If he's willing you'd be better off than taking him to court. That's my hunch. Thanks and good luck!

    Sorry Muziek. Didnt mean to go off on you. The whole thing just pisses me off. I would not do this to someone. It hurts when you think you can trust someone and they pull this kind of crap.

    Wishes mean nothing. I am still paying for this laptop, therefore your hope of forgiveness is dead.
    We are not friends, we are co-workers, and since it looks as though you are unable to make Aflac work for you, that may no longer be true. I tried to help you out when you were down by offering you an opportunity and support. That included time, money and my property. It's not my fault you couldn't make it work. I lost plenty on charge backs and presentations and appointments that went nowhere. You're nuts if you think I will accept more loss.
    I don't care how you do it, but you will pay the balance you owe. You made the error that led to it's theft and it is your responsibility. Borrow from your 401K, ebay more of the stuff you have left from your old job, whatever I don't care.

    You have 15 days to come up with something. The full amount, a payment plan, something. If you have not done so by February 13th, I will sue you in small claims court.

    Step up and be a man and take responsibility for your actions.


    After I sent this I was reading the thread on TC. I saw my own signature and it made me realize that even if I dont get what I want from this loser, he will get his in the end.

    I just wish I could give her a ride to his house.

    im arriving late to this discussion here, woof. I think you have offered dan the correct ultimatum here.

    it baffles me that someone would make such a boneheaded error with a $3000 labtop. unbelievable - hide it, carry it with you, SOMETHING! don't leave it in plain view - that's incredible that he did this.

    his $1000 was a start, but he definitely owes you monthly payments from now on until the you are made whole again. that's just the plain truth of this.
    you would think he would OFFER to make payments on this rather than make YOU have to chase him on this deal. its amazing how people behave like this!

    I wish you the best on this, woof. I think you're handling it appropriately, just make sure you acquire the counsel of a damn good lawyer here as well.

    I may be way off here in saying this. if I am, fine. but the thought occurred to me after reading your letter to him regarding "selling the stuff he stole from oliverri"

    is this guy a thief? because he may have staged this "breakin" to LOOK like it was stolen, when maybe HE's the one who stole it!!

    all im saying here is that if he's capable of stealing from oliverri or whomever that was, than that raises questions into his character, doesn't it? he pays you $1000 or rather he has the insurance co pay you $1000, then he turns around and sells the laptop of ebay for $3000.

    now maybe im wrong here, probably am, but just thought id post this thought here because days nothing surprises me - people are capable of anything. since he's not your friend, just a coworker, this is even more possible.

    This actually my whole problem. I am in shock that he hasn't at least offered something. If it were reversed I certainly would. I spent 6 months training and coaching and helping him and this is the thanks I get.

    I agree with your letter, you are firm, but still give him the chance to work things out..
    A resonable payback scheme seems the answer to me.. hope you don't have to take him to court, without written loan agreement things could get hairy

    That's a pretty good letter. A bit harsh, but you're been jerked around and nobody can fault you for it.

    Now, you need to let it lie. I wouldn't contact him again, if I were you. Otherwise, you might poke your toe into the realm of harassment and give him recourse to come after you. You've given him a timeframe. Now let him either meet it ot meet you in court.

    Best of luck with this whole mess.

    Ya thats the last he hears from me until he is served with lawsuit papers. Hopefully it will do the trick and I wont have to do it.
