ITC Wars aka Silver lining for TouchPad/webOS?

With Apple vs Android (via HTC), and Microsoft vs Motorola, would it be possible that someone can pick up webOS (where HP dropped it off) and possibly make it #2?
The ITC said that HTC did infringe on 2 Apple patents, which seem to be at the core of the OS (Android). Decision on the appeal to come out in December. And Microsoft trying to ban the sale of Motorola phones (Android) because of patent infringements.
While the ban of all Android devices seems far fetched, it definitely seems that there will be some ramifications here.
Would be great to see the tortoise webOS creep past at least one hare, if it were to be picked up by someone.
I'm no expert though.
