    Here's the situation:

    My Treo 600 was stolen from my house by a person who was my guest. I know who the thief is. She is untraceable. More particularly, a 'friend' of mine was paid to keep quiet about the theft (from proceeds from the selling of the phone). He was not involved directly, only paid not to tell me about it. He is sixteen years old.

    My question is this:

    If the police were involved (in America), would my friend likely be charged? And if found guilty, what kind of sentence would he receive?

    I'm asking this question because I'm having difficulty putting the incident into perspective.

    Well, IMHO your "friend" is no friend at all. Most municipalities grade the severity of the theft based on the dollar value of the item stolen. I am sure your "friend" would be considered and accomplice and could even be charged with a count of conspiracy for excepting money for his silence. Frankly, he actions are more deplorable then the original theft, because he took money to keep his mouth shut.

    Turn your back in this looser and dont think twice about it. Thats goes for the thief too.

    Your "friend" would likely be charged in the States. If found guilty, the sentence would be neglible (cheap phone). In any case, if you could prove this person did it, he would likely cop a plea and get off with a warning.

    But at least a night in jail for 16 year old would teach him something

    Why on earth, (Jakarta or the US) would you be concerned about punishment of a supposed friend who accepted money not to tell you about the theft of your property?

    This should be obvious to you where your "friends" loyalty lies.

    Did you check to see if you have other personal property missing?

    I'm concerned about the punishment because I could use the knowledge of it to impress upon him the seriousness of the crime. "If you'd done this to someone in the States you'd have been bla bla bla...".

    Since you are outside the US, the Treo must be a GSM version? Why not call your own number and sms it repeatedly asking for the anonymous return of the Treo and claiming 'someone' told you who the theif was.

    In the US, Treos can be found using triangulation from cell towers if they are used. Stealing one doesn't make any sense since the carrier would not activate it on a new contract. Good luck, perhaps you could remind you 'friend' about an effective way thieves are delt with in Saudi Arabia... their left hand is cut off... forcing them to wipe with the right, the hand they eat with!

    No matter what the punishment...or lack of...there is always the record. It will be sealed when he comes of age, but until then it could be VERY hard to get a job, into a school of your choice, disqualify for certain financial aids or schalorships, etc....

    He means (I assume) that he want to explain the grafity of the situation by saying if you were in country X you would be hanged for this (or any other severe punishment)
