On a way too long plane flight I saw an add for this and was wondering if Handspring will have trouble because another device is already called Treo?

    That's actually the "TREÓ" (tm).
Note the accent mark, and see the press release.

so, name's not *exactly* the same, but I'm sure we can expect a lawsuit based on similarity/confusion or dilution of trademark.

Alas, poor Yorick, i knew he wasnt a lawyer.

There could be a problem here for Handspring a la Microsofts XBox: MS announced the product without securing an intent to use trademark and there was another game system already registered. Its settled now with MS acquiring the rights for big $$$.

The HS Treo and the Treo MP3 are not exact hits like the XBox, but with only three live trademarks for "Treo" (and only one in electronics) it aint exactly a crowded field that could absorb similar uses (think of all the trademarks using the word "Eagle"). The MP3 maker has a two year old intent to use application and a "Treo" search doesnt show any application by Handspring (although the USPTO website is behind filings).

If playing on the safe side, they just might be launching it with another name...

hmmm, and I came here in search of any mention of mp3 software for the Treo since it has headphone jack and 16mb or memory. Then I see there is another product called Treo` which just happens to be an mp3 player. Not a good sign.
Still 16mb isn't much room for mp3 tunes in addition to programs...sigh (never satisfied, I want it ALL in one unit!) (digital camera would be nice too)

MacFixit.com pointed me to this article, which discusses the Treo Player, the iPod, and the Handspring Treo, as well as past trademarks using the Treo name.
