Sounds like the Pre has a finicky earphone jack. I have heard of this happening on multitiudes of phones over the past few years.
If it won't go away--no matter what you've done, I suggest using WebOS doctor found at
www.palm.com/ROM
If that doesn't fix it, take it back.
